www.weblio.eu1. Scope of Application
These Terms and Conditions govern the legal relationship between Weblio (hereinafter "Provider") and customers, unless otherwise agreed in writing.
By placing an order, making a booking, or using our services, the customer accepts these Terms and Conditions. For online orders, acceptance is confirmed during the ordering process.
2. Services
The Provider offers digital services, particularly in the areas of web design, web hosting, email hosting, website maintenance, consulting, as well as software tools and subscriptions. The exact scope and current prices are based on the respective quote, order confirmation, or the offers published on www.weblio.eu.
3. Contract Formation
A contract is formed through written confirmation by email, acceptance of a quote, or completion of an order on www.weblio.eu.
4. Right of Withdrawal and Digital Services
For digital services (hosting, email, website maintenance, software subscriptions, domains), service begins immediately upon receipt of payment. By placing an order, the customer expressly agrees that service begins immediately and acknowledges that this extinguishes the right of withdrawal.
For custom project work (web design, consulting), the right of withdrawal expires once the Provider has begun execution and the customer has agreed to this.
5. Prices and Payment Terms
All prices are in Euro (EUR) or Swiss Francs (CHF), depending on the customer's location. The Provider is not subject to VAT.
For orders up to CHF/EUR 2,000, advance payment applies. Delivery occurs after full payment receipt.
For orders from CHF/EUR 2,000: 50% deposit upon order placement, 50% before publication or completion.
Ongoing services (hosting, email, website maintenance, software subscriptions) can be booked via www.weblio.eu. Provision occurs after payment receipt. Ongoing services are invoiced monthly or annually in advance.
Certain services may be subject to a minimum contract period. This is clearly indicated before contract conclusion and confirmed by the customer during the ordering process. During the minimum contract period, ordinary termination is excluded; after its expiry, the subscription transitions to a regularly terminable subscription.
Accepted payment methods are determined by the options offered in the ordering process.
6. Customer Cooperation
The customer is obligated to provide content, information, and access data required for service delivery in a timely manner. Delays attributable to the customer extend the delivery period accordingly and do not entitle to reduction or withdrawal.
7. Delivery and Acceptance
Delivery times for projects are agreed upon in the quote. Since no physical products are delivered, there is no shipping risk.
The project is considered accepted when the customer expressly approves it or does not report defects in writing within 7 days of the completion notification.
8. Support and Maintenance
Depending on the service, a support phase for minor adjustments and bug fixes may be included after project completion. The exact duration is specified in the quote or selected package. Additional support is quoted separately.
For website maintenance packages, the scope of services (e.g., included change hours, response times, monitoring) is determined by the selected package as described on www.weblio.eu. Services not included in the package may be quoted separately upon request. The Provider communicates with the customer via email, ticket, or WhatsApp.
9. Termination
Ongoing services (hosting, email, website maintenance, software subscriptions) may be cancelled at the end of the respective billing period, provided no minimum contract period has been agreed. If a minimum contract period has been agreed, ordinary termination is only possible after its expiry. The minimum contract period is clearly indicated before contract conclusion.
Cancellation is made through the customer dashboard on www.weblio.eu and takes effect at the end of the current billing period. For annual subscriptions, cancellation takes effect at the end of the respective annual term.
One-time orders such as web design or consulting cannot be unilaterally cancelled after order confirmation. Payments already made will not be refunded.
After the billing period expires, the account will be deactivated. Email data will be irrevocably deleted upon deactivation – the customer will be explicitly informed about data backup via email upon cancellation. Website data will be permanently deleted after 7 days. Within these 7 days, a paid reactivation is possible for a one-time fee of CHF/EUR 39.
10. Non-Payment for Ongoing Services
If payment for ongoing services is not made on time, the service will be deactivated after an unsuccessful payment reminder. Email data will be irrevocably deleted upon deactivation. Website data will be permanently deleted after 30 days. Reactivation is only possible after full settlement of outstanding amounts and a one-time reactivation fee of CHF/EUR 39.
11. Availability
The Provider strives to ensure high availability of hosting services. Server infrastructure is operated at ISO-certified data centers in Switzerland and Germany. Short-term interruptions for maintenance work or due to force majeure do not entitle to compensation.
12. Liability
To the extent permitted by law, the Provider's liability is limited to the amount paid for the respective service.
No liability is assumed for indirect damages, lost profits, data loss, or third-party services (e.g., hosting providers, payment service providers).
Liability for intent and gross negligence remains unaffected.
13. Data Protection
Personal data is processed in accordance with the privacy policy on www.weblio.eu. Third-party providers such as hosting and payment service providers may be used.
14. Copyright and Usage Rights
For web design orders, usage rights to the created website transfer to the customer upon full payment.
For software subscriptions and tools, the customer receives a non-exclusive usage right for the duration of the subscription.
The Provider reserves the right to use projects as references unless otherwise agreed.
15. Changes to Terms and Conditions
The Provider reserves the right to change these Terms and Conditions at any time. Changes are published on www.weblio.eu and take effect upon publication. Customers with ongoing contracts will be notified by email of significant changes.
16. Severability Clause
Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose.
17. Applicable Law and Jurisdiction
Swiss law applies exclusively, excluding international private law. The place of jurisdiction is Switzerland.
